On June 6, the 3rd District Court of Appeal overturned a trial court ruling permitting FIPO to treat the 2010 pension changes as invalidated by the Headley decision.  The Court held that until PERC issues a final order, following the back pay proceeding, that the 2010 ordinance will stand.  PERC has already held that the City must rescind the 2010 imposed pension changes in a non final order and that ruling is unlikely to change in the final order. In the interim, FIPO must follow the old ordinance.  FIPO is preparing to ask the Court to clarify or change its ruling.  In essence, the Court ruling delays the implementation of the Headley decision but does not change it. The Board will address the impact of the ruling at its June meeting.  The back pay cases for Fire and Police will be held on June 14 and June 18 respectively.  Final orders are expected in the early fall.
