The City of Miami Fire Fighters' and Police Officers' Retirement Trust


Today, Miami Dade Circuit Judge Reemberto Diaz ruled in favor of FIPO on its efforts to restore the formulas changed by the 2010 ordinance and declared unconstitutional as a result of the Supreme Court decision in Headley.  He also stayed the City’s case in order for the parties to conciliate the matter under Chapter 164, Florida Statutes.  That law requires governmental entities to make a concerted effort to work out their differences before one sues the other.

The adjusted calculations for certain retirees will be in the January 15th payment as directed by the Board.  Until the PERC back wages case is concluded, any adjustments due to salary reductions will not be addressed.

We expect the City will continue to try and stop this effort and will try to force FIPO to recover any of these payments which they claim are premature.
